What is the Mandatory Property Disclosure Form?

The Mandatory Property Disclosure Form (MDF) is required by section 67 of the Property Practitioners Act 22 of 2019. It is a written disclosure by the seller of all defects in and condition of the property — structural, electrical, plumbing, security, pool, exterior, and legal items. It must be signed by both seller and purchaser before signing the Offer to Purchase.

What happens if a seller doesn’t complete the disclosure form?

If no disclosure form is provided, the property is deemed to have been sold without any defects, and the buyer can hold the seller liable for any defects discovered after transfer — even with a voetstoots clause. Sellers should complete the form honestly to protect themselves and to comply with the law.

Does the buyer have to sign the disclosure form?

Yes. Both the seller and the buyer must sign the disclosure form. The buyer’s signature confirms that they received the form and had the opportunity to consider the disclosures before signing the Offer to Purchase.
