These Terms of Use ("Terms") govern your access to and use of the website located at mjkinc.co.za, including all of its pages, articles, guides, interactive tools, and downloadable materials (collectively, the "Website"). The Website is owned and operated by MJ Kotze Incorporated ("MJ Kotze Inc", "the firm", "we", "us", "our").

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website. These Terms constitute an agreement concluded by electronic means as contemplated in sections 11 and 22 of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").

Where you transact with us through the Website — for example, purchasing a document template, booking a consultation, or accepting a fee proposal — additional terms are presented to you at the point of that transaction and apply to it in addition to these Terms. Where you are a client of the firm, our engagement terms govern the professional relationship and prevail over these Terms to the extent of any conflict.

4. No Attorney–Client Relationship

Extracts from legislation and judgments quoted on the Website are reproduced from public sources and remain subject to their own terms; the selection, arrangement, and accompanying commentary are the firm's own work and are protected as such.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access the Website and to view, download, and print its content for your personal, non-commercial reference, provided that you do not modify the content and that you retain all copyright and other proprietary notices. Any other use of the content requires our prior written permission.

9. Templates and Other Downloadable Materials

Document templates and similar materials made available for download from the Website are licensed, not sold, and their use is governed by our Template Licence & Disclaimer, which you accept when you download or use a template. To the extent of any conflict between these Terms and the Template Licence in relation to a template, the Template Licence prevails.

10. Client Portals and Secure Areas

Parts of the Website are accessible only to registered users, such as client and agent portals. Access to those areas is granted in connection with a professional engagement and is governed by the applicable engagement terms in addition to these Terms. You are responsible for keeping your login credentials confidential and for all activity conducted under your account, and you must notify us promptly if you suspect any unauthorised use of it.

11. Accuracy and Currency of Legal Information

The law changes. Legislation is amended, regulations and tariffs are updated, and courts hand down new decisions. While we take care to state the law accurately as at the date a page is published or last reviewed, we do not warrant that any content is accurate, complete, or current at the time you read it, and we are under no obligation to update any content. References on the Website to legislation and case law link, where possible, to the published source so that you can verify the authority for yourself.

If you continue to use the Website after an amendment is published, you will be taken to have accepted the amended Terms. These Terms are governed by the law of the Republic of South Africa, and you consent to the jurisdiction of the South African courts in respect of any dispute arising from them or from your use of the Website.
