Frequently asked questions
Why a clickwrap Cloud Services Agreement instead of a master service agreement?
A clickwrap Cloud Services Agreement is built for self-serve, online SaaS — customers accept it electronically at sign-up, and it is enforceable under the ECTA. A negotiated master service agreement suits bespoke enterprise deals and is available as a separate engagement if you need one alongside it.
Does the package include an SLA and support terms?
Yes. Uptime/availability commitments and service credits are in the SLA Addendum, and support tiers, response targets and escalation are in the Support Addendum — both included in the package.
Does the DPA cover cross-border transfers and sub-processors?
Yes. The Data Protection Addendum includes cross-border transfer clauses consistent with POPIA section 72 and the operator-chain provisions for international sub-processors (AWS, GCP, etc.).
What does the AI Features Addendum cover?
It governs your AI/ML features — ownership of inputs and outputs, whether customer data may be used for training, acceptable use, and appropriate disclaimers — so your AI functionality is contractually covered from launch.
